TERMS OF USE FOR MOBSPAWNER

2. SCOPE AND DESCRIPTION OF THE SERVICE

These Terms of Use govern the use of the Mobspawner web application and its related websites, user accounts, application programming interfaces, administration interfaces, clients, background services and functions expressly identified as part of Mobspawner.

Mobspawner is an independent application for integrating streaming platforms and may provide, in particular, the following functions:

  • connecting Mobspawner accounts to Google, YouTube or Twitch accounts;
  • processing live-chat commands and platform events;
  • publishing automated bot messages and bot responses;
  • managing streamers, channels, roles, moderators and permissions;
  • checking memberships, subscriptions, roles or released status information;
  • an internal points, bonus, reward and cooldown system;
  • connecting to supported games, emulators, clients or local runtime components.

The specific scope of functions depends on the role enabled, the connected channel, the platform used, the client version, the technical environment and the functions displayed and enabled within Mobspawner at the relevant time.

Unless expressly stated otherwise, Mobspawner does not provide the streaming platform, the relevant game, emulator, console, required internet connection or other third-party software.

3. CONTRACT FORMATION AND ACCEPTANCE

The user agreement is formed when the user signs in to Mobspawner through Twitch or YouTube for the first time and a Mobspawner account is thereby created. By completing this first sign-in, the user confirms that they have taken note of the current Mobspawner Privacy Policy and have read and accepted these Terms of Use.

No additional individual agreement, separate service description or further declaration of acceptance to Pos-IT e.U. is intended or required to use Mobspawner. These Terms of Use, in their applicable version, govern the user relationship.

Merely participating in a YouTube or Twitch chat does not constitute a first sign-in to Mobspawner and does not create a user agreement with Pos-IT e.U. Chat participants remain subject in particular to the rules of the relevant platform and channel. Where a chat command is processed through Mobspawner, the functional and anti-abuse rules described in these Terms of Use also apply.

The Privacy Policy separately explains the processing of personal data and does not replace any consent that may be required.

4. ELIGIBILITY, MINORS AND AUTHORITY

Mobspawner may only be used by persons who have the legal capacity required for such use. Minors may use Mobspawner only where permitted by applicable law and, where required, with the consent of their legal representative.

The minimum-age, account and usage rules of each connected platform also apply.

Anyone setting up Mobspawner for a business, association, organisation, channel owner or another person confirms that they have sufficient authority to do so. Accounts or channels with write permissions, particularly for bot messages, may only be connected by their owner or an expressly authorised person.

5. USER ACCOUNTS AND ACCOUNT SECURITY

Users must provide accurate information when first signing in to and using Mobspawner and must update their account information following material changes.

Login credentials, recovery codes, OAuth authorisations, API keys and other security information must be kept confidential. Users must not enable unauthorised third parties to access their Mobspawner account or connected platform accounts.

Suspected account misuse, loss of credentials or an unauthorised platform connection must be reported immediately to office@pos-it.at. To protect the user or the system, Pos-IT e.U. may terminate sessions, reset credentials or temporarily suspend accounts.

Multiple accounts must not be used to circumvent suspensions, cooldowns, points limits, role checks or other safeguards. Users are responsible for actions taken through their account to the extent that those actions or inadequate account security are attributable to them.

6. PLATFORM CONNECTIONS AND OAUTH AUTHORISATIONS

Users may connect only Google, YouTube, Twitch, bot or channel accounts that they own or are demonstrably authorised to manage.

The permissions requested are displayed by the relevant platform provider before authorisation. Users decide whether to grant those permissions. An authorisation may be revoked through Mobspawner or through the security settings of the relevant platform.

Disconnecting or revoking a platform connection may cause dependent functions, role checks, bot responses, synchronisations or channel mappings to stop working. Content already published directly on YouTube or Twitch is not automatically deleted when the connection is removed from Mobspawner.

Users must not extract, misuse, disclose or sell OAuth tokens, access credentials or platform information, or use them to circumvent platform restrictions.

7. SPECIAL TERMS FOR YOUTUBE

Mobspawner uses YouTube API Services and Google OAuth 2.0 for YouTube functions that users choose to enable. By starting the YouTube connection, the user confirms that they have taken note of the current Mobspawner Privacy Policy and have read and accepted these Terms of Use.

By using YouTube-related functions of Mobspawner, the user also agrees to the YouTube Terms of Service and agrees to be bound by them.

YouTube-related functions must not be used for spam, harassment, misleading bot activity, artificial interactions, manipulated platform metrics, unauthorised data collection, circumvention of access restrictions or any other breach of YouTube rules.

Mobspawner performs only those write actions that have been expressly enabled by the relevant user or channel owner. Google or YouTube may restrict, change or terminate permissions, accounts, API access, quotas or functions at any time under their own rules. As a result, YouTube functions of Mobspawner may become temporarily or permanently unavailable.

8. SPECIAL TERMS FOR TWITCH

Mobspawner uses Twitch OAuth and Twitch application programming interfaces for Twitch functions that users choose to enable.

When using Twitch-related functions, users must comply in particular with the Twitch Terms of Service and Twitch Community Guidelines:

Twitch-related functions must not be used for spam, harassment, hateful conduct, fraudulent interactions, artificial viewer or engagement activity, unauthorised chat automation, circumvention of moderation measures or any other breach of Twitch rules.

Twitch may restrict, change or terminate permissions, accounts, API access or functions under its own rules. As a result, Twitch functions of Mobspawner may become temporarily or permanently unavailable.

9. ROLES AND RESPONSIBILITY OF THE STREAMER AS CHANNEL OWNER

The streamer role is not assigned automatically. Users must apply to Pos-IT e.U. to be enabled as a streamer. Pos-IT e.U. reviews the request and decides which users are enabled as streamers within Mobspawner.

Users without an active streamer role must generally not conduct a livestream on YouTube or Twitch using Mobspawner. This prohibition expressly includes all trial, test and demo versions and applies regardless of whether the stream is monetised. An exception applies to an occasional, non-regular presentation of Mobspawner where the user submitted a streamer application to Pos-IT e.U. before the stream began and that application is still under review. The exception ends when a decision is made on the application; following a rejection, use during a livestream is not permitted. Use of a trial version outside a livestream remains permitted within the functionality provided for testing.

A breach may result in suspension or withdrawal of access to trial versions and other Mobspawner functions, suspension of the account and, in accordance with section 17, temporary or permanent exclusion from use of the Mobspawner platform.

The enabled streamer is the owner of the Twitch or YouTube channel that they connect to Mobspawner. The streamer role may be assigned or revoked only by Pos-IT e.U. and cannot be transferred by the channel owner to another person. The streamer may authorise other persons as head moderators, moderators or in other supported channel roles.

The channel owner is responsible in particular for:

  • the lawful connection of the channel and bot account used;
  • selecting and continuously reviewing authorised persons;
  • configuring commands, roles, cooldowns, points, bonus rules and rewards;
  • wording custom bot texts and publicly displayed content;
  • complying with platform rules, channel rules, youth-protection requirements and other applicable laws;
  • moderating their own chat and appropriately informing their community;
  • fulfilling rewards or benefits offered by the channel owner.

Authorised users may act only within their assigned role. The channel owner must promptly revoke permissions that are no longer required or are being misused. Pos-IT e.U. may restrict role and permission configurations that are technically unsafe or abusive.

10. CHAT COMMANDS, BOT MESSAGES AND PUBLIC VISIBILITY

Mobspawner processes enabled commands and platform events on a rule-based and generally automated basis. A command may trigger, in particular, a role check, points check, cooldown, points transaction, bot response, reward or event in a connected game or client.

Bot messages and bot responses are published in the relevant YouTube live chat or Twitch chat and are visible to all persons who can view that chat. This also applies where a response was triggered by the message or command of a single user. A bot message may include, in particular, a username, publicly visible platform identifier, command status, points balance, role or command result.

There is no entitlement to have every command accepted, answered or successfully executed. Commands may be rejected or delayed, in particular, because of missing permissions, insufficient points, cooldowns, moderation measures, technical errors, platform delays, API limits or a disabled function.

Deleting a Mobspawner account or disconnecting a platform account does not remove chat messages already published directly on YouTube or Twitch. Such content must, where possible, be managed on the relevant platform.

11. POINTS, BONUS RULES, MEMBERSHIP BENEFITS AND REWARDS

Mobspawner points, bonus factors, roles and reward data are internal, generally channel-specific functional data of Mobspawner. They are not official metrics, ratings or statistics of Google, YouTube or Twitch and are not used to create cross-channel performance rankings.

Mobspawner points:

  • have no monetary value;
  • are not legal tender, electronic money, securities, financial instruments, crypto-assets or savings deposits;
  • do not create a right to payment or conversion into money;
  • must not be sold, traded, transferred or combined between channels unless an expressly provided function permits this.

The channel owner may determine how points are credited or deducted, which cooldowns apply, which roles or membership statuses receive benefits and which rewards are offered. Where a reward is offered by the channel owner or a third party, that party is responsible for its description, availability, legality and fulfilment. Pos-IT e.U. is the provider of a reward only where this is expressly stated.

Following an appropriate review, Pos-IT e.U. or the authorised channel owner may correct or reverse points transactions that are erroneous, duplicated, technically incomplete or obtained through manipulation. Users may challenge such a correction by contacting office@pos-it.at.

Points must not be used for gambling, betting, paid random prizes or other regulated financial or prize models unless a separate, legally reviewed function with its own rules is provided.

Associated points and unredeemed virtual benefits may be lost when an account is deleted, a user is removed from a channel, a channel is permanently discontinued or the relevant function is terminated. Mobspawner points and virtual benefits cannot be purchased for money; no cash payment or paid reimbursement will be made.

12. CLIENTS, GAMES, EMULATORS AND THIRD-PARTY SOFTWARE

Mobspawner may work with local clients, games, emulators, mods, plugins or other third-party software. Such integrations may change the state of a running game and may affect save data, configurations, runtime stability or the presentation of a stream.

Before use, users must create suitable backup copies of save data, configurations and other important data and must first test new integrations in a safe environment. Compatibility may depend in particular on game version, region, emulator version, modifications, operating system, hardware, network and client version.

Users may use only games, firmware, BIOS files, ROMs, keys, mods, plugins and other content that they have lawfully acquired or are otherwise lawfully entitled to use. Mobspawner does not provide pirated copies, circumvention keys or other content intended to bypass technical protection measures. Mobspawner must not be used to circumvent copy protection, licence checks, anti-cheat systems or other security measures.

The licence and usage terms of the relevant games, emulators and third-party providers must be observed. Mobspawner is not intended for safety-critical systems, real-world machinery controls, vehicles, medical devices or other uses where a malfunction could cause personal injury or substantial property damage.

13. PROHIBITED USE

The following is prohibited in particular:

  • use for unlawful purposes or to infringe the rights of third parties;
  • distributing unlawful, threatening, harassing, discriminatory, hateful, defamatory or privacy-infringing content;
  • spam, deception, impersonation, artificial interactions or manipulation of viewer, engagement, membership or other platform metrics;
  • unauthorised use of third-party accounts, channels, bot accounts, OAuth tokens, API keys or credentials;
  • points fraud, multiple-account abuse, replaying previously processed events or circumventing cooldowns, suspensions and role checks;
  • attacks against Mobspawner or third-party systems, including malware, denial-of-service attacks, automated vulnerability scans without consent, unauthorised scraping or circumvention of API limits;
  • exploiting or publicly disclosing a security vulnerability before Pos-IT e.U. has had a reasonable opportunity to remedy it;
  • reverse engineering, decompilation or circumvention of technical protection measures except where mandatorily permitted by law;
  • use for software piracy, copyright circumvention or breach of licence and anti-cheat rules;
  • use for gambling, betting, financial services or real-world effects on property or persons without separate written approval and legal review;
  • any use that materially impairs the stability, security or proper operation of Mobspawner, connected platforms or other users.

Security vulnerabilities should be reported confidentially to office@pos-it.at.

14. USER CONTENT AND CONFIGURATIONS

Depending on their role, users may provide bot texts, command names, descriptions, images, graphics, rule sets, rewards, configurations or import data. Rights in such content remain with the relevant rights holder.

The user confirms that they hold all rights and permissions required for the intended use. In particular, users must not upload or publish content that infringes copyright, trade mark rights, personality rights, privacy rights or other third-party rights.

For the duration of the service, the user grants Pos-IT e.U. a non-exclusive, royalty-free permission limited to operating Mobspawner to store, technically reproduce, process and display the submitted content in the intended channel or dashboard and to transmit it to processors used for this purpose. No broader advertising use will take place without separate consent.

Pos-IT e.U. may block or remove content or configurations, or prevent their output, where there are specific indications of a violation of law, platform rules, a security risk or a material breach of these Terms of Use. Where reasonable, the affected user will be informed of the reason and scope of the measure.

Notices concerning unlawful or infringing content may be sent to office@pos-it.at. The notice should identify the content concerned, its location and the reason for the complaint as precisely as possible.

15. FREE PROVISION, AVAILABILITY, RESOURCES, MAINTENANCE, UPDATES AND TEST FEATURES

Mobspawner is currently provided exclusively free of charge. Pos-IT e.U. does not currently offer any paid services within Mobspawner.

Pos-IT e.U. uses reasonable efforts to operate Mobspawner securely and reliably. However, Mobspawner is provided only for as long as and to the extent that the technical, personnel, financial and other operational resources required for its operation remain available. To the extent permitted by law, users have no entitlement to permanent provision, continuation of particular functions, a specific minimum availability or uninterrupted accessibility.

If the required resources are no longer sufficiently available, Pos-IT e.U. may restrict, temporarily suspend or discontinue individual functions or terminate the operation of Mobspawner as a whole. Where reasonably possible and unless urgent security reasons or short-notice changes affecting required third-party platforms prevent it, affected users will be informed with reasonable advance notice.

Operation and functionality may be affected in particular by:

  • maintenance, security updates and troubleshooting;
  • outages or changes affecting Google, YouTube, Twitch, hosting, network or other third-party providers;
  • API quotas, platform limits, moderation measures or revoked permissions;
  • incompatible game, emulator, mod, operating-system or client versions;
  • force majeure or other events outside the reasonable control of Pos-IT e.U.

Security-related updates may be mandatory. Outdated or insecure clients may be blocked from accessing the service.

Functions labelled beta, preview, experimental or test may be incomplete, contain errors, be changed or be discontinued. Users should not rely on such functions for business-critical or stream-critical processes without suitable safeguards.

16. PRIVACY

Information about the nature, purposes, legal bases, recipients and retention periods of personal data is provided in the Mobspawner Privacy Policy:

Acceptance of these Terms of Use does not replace consent under data-protection law. Where consent is required, it will be obtained separately and may be withdrawn in accordance with the Privacy Policy.

The privacy notices of the relevant platform providers additionally apply to processing carried out by Google, YouTube and Twitch. Users should not disclose special categories of personal data or other confidential information in bot texts, support requests or configurations unless this is necessary for the relevant function.

17. SUSPENSION, CORRECTIONS AND TERMINATION

Users may disconnect platform accounts at any time and may generally terminate a free Mobspawner user relationship at any time. Account deletion and termination are additionally governed by the account functions provided in Mobspawner and the Privacy Policy.

Pos-IT e.U. may temporarily suspend or permanently terminate accounts, individual functions, commands, platform connections or roles where, in particular:

  • there is a material or repeated breach of these Terms of Use;
  • a security incident, account misuse or suspected manipulation exists;
  • a legal obligation, authority order or legitimate platform request requires the measure;
  • there is an immediate risk to other users, platforms or systems.

In urgent security, abuse or legal cases, a measure may be taken without prior notice. In other cases, an appropriate opportunity to remedy the issue or prior information will generally be provided where reasonable in the circumstances.

Provided that investigations, security measures or third-party rights are not prejudiced, Pos-IT e.U. will inform the user of the principal reason and expected duration of a suspension. Affected users may request a review by contacting office@pos-it.at.

The channel owner may independently revoke channel-related roles and access. Account deletion or termination may result in the loss of internal points, roles and unredeemed virtual benefits. Content already published on YouTube or Twitch is not automatically deleted as a result.

Pos-IT e.U. may restrict or discontinue free functions or the free service as a whole in accordance with section 15.

Provisions that are intended by their nature to survive termination, including those relating to intellectual property, liability and disputes, remain effective.

18. INTELLECTUAL PROPERTY AND TRADE MARKS

The Mobspawner project has existed since early 2026, when its development began.

Except for expressly identified third-party and open-source components, all rights in and to Mobspawner and its components—including its source and object code, software architecture, user interfaces, documentation, databases, graphics, names, logos and trade marks—and all copyrights, exploitation and usage rights, database rights, trade mark rights, trade name rights, trade secret rights and other intellectual property rights recognised under applicable law are owned by, assigned to or validly licensed to Pos-IT e.U.

Pos-IT e.U. and its licensors reserve worldwide all rights not expressly granted to users under these Terms. No ownership or intellectual property rights are transferred to users through their use of Mobspawner.

For the duration of the agreement, users receive a limited, non-exclusive, non-transferable and non-sublicensable right to use Mobspawner within its intended scope. Reproduction, resale, rental, sublicensing, public provision, white-label use or commercial redistribution is not permitted without express written consent.

Trade marks, logos, games, characters, platform names and other third-party content remain the property of their respective rights holders. Mobspawner is an independent application and, unless expressly stated otherwise, is not affiliated with, endorsed by or sponsored by Google, YouTube, Twitch, Nintendo, game publishers or emulator developers.

Descriptive use of terms such as “crowd control” or similar functional descriptions does not establish an affiliation with third-party products or trade marks.

19. WARRANTY

Mandatory statutory warranty rights, particularly consumer rights relating to digital services, remain fully unaffected.

The expressly agreed service description at the time of contract formation and mandatory statutory requirements determine the agreed characteristics of the service. General product descriptions, roadmaps, test features or non-binding statements about future functions do not constitute a guarantee of characteristics.

Pos-IT e.U. does not warrant that third-party platforms, games, emulators, mods, plugins or other external components will remain unchanged, available or compatible with every technical configuration. This does not limit the responsibility of Pos-IT e.U. for defects attributable to its own service.

Defects should be reported to office@pos-it.at with as much detail as possible, including the affected function, time, client version and available diagnostic data.

20. LIABILITY FOR DIGITAL SERVICES AND CONTENT

Mobspawner is provided free of charge as a digital service and content offering. It comprises digital services and digital content, including in particular the web application, server-side services, application programming interfaces, platform and game integrations, and any client or software components offered.

These Terms of Use do not restrict mandatory statutory claims or liability rules. The Austrian Consumer Warranty Act (VGG), the Austrian Consumer Protection Act (KSchG), the Austrian Civil Code (ABGB) and other mandatory consumer rights remain unaffected to the extent that they apply to Mobspawner.

Pos-IT e.U. is liable only for damage caused by an act or omission of Pos-IT e.U. that is legally attributable to Pos-IT e.U. and for which Pos-IT e.U. is responsible under applicable law. The use, opening, unavailability or malfunction of Mobspawner alone does not establish liability.

Potential attributable damage in connection with Mobspawner concerns in particular digital data, local save data, configurations, user accounts or the functionality of the digital components provided. Liability for such digital damage also exists only where the statutory requirements and the following provisions are satisfied.

Cases of liability that cannot legally be limited remain unaffected. Limitations of liability apply only to the extent permitted by the applicable mandatory law.

For consumers, the statutory liability rules otherwise apply.

For business users, liability for slight negligence is excluded unless an essential contractual obligation has been breached. In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable loss typical for the contract at the time the agreement was formed. For business users, liability for indirect loss, consequential loss, loss of profit and pure business-interruption loss is excluded to the extent permitted by law.

Pos-IT e.U. is not liable for interruptions, suspensions, data changes or loss of functionality caused exclusively by Google, YouTube, Twitch, internet or hosting providers, games, emulators, mods, hardware, local configurations or unlawful or contract-breaching use. This does not apply where Pos-IT e.U. is responsible for the cause.

Mobspawner may transmit actions authorised by the user or channel owner to connected games, emulators or clients. An authorised change in a game or client that is carried out as intended does not by itself constitute damage caused by Pos-IT e.U. Liability for unintended effects for which Pos-IT e.U. is responsible under applicable law remains unaffected.

The restriction or discontinuation of free functions permitted under section 15 does not by itself give rise to a claim for damages. This does not apply to damage already caused or where Pos-IT e.U. is liable under mandatory law.

Mobspawner does not guarantee any particular streaming success, viewer numbers, revenue, platform approval or game outcome.

Users must maintain current backup copies of local save data, configurations and other important data to a reasonable extent. Where legally permitted, the loss caused by data loss will be assessed by reference to the restoration effort that would have been required if proper backups had been maintained.

21. INDEMNITY BY BUSINESS USERS

This section applies only to users acting in the course of business.

The business user will indemnify Pos-IT e.U. against justified third-party claims arising from unlawful use of Mobspawner attributable to the business user, infringing user content, lack of authority for a connected account or a culpable breach of these Terms of Use.

The indemnity covers reasonable and necessary legal-defence costs. Pos-IT e.U. will inform the business user of a claim and, where reasonable, provide an opportunity to participate in the defence. No indemnity applies to the extent that Pos-IT e.U. caused or contributed to the claim.

22. CHANGES TO THESE TERMS OF USE

Pos-IT e.U. may amend these Terms of Use where there is an objective reason, including in particular:

  • changes in legal or regulatory requirements;
  • changes to the terms of Google, YouTube, Twitch or other necessary third-party providers;
  • security, abuse-prevention or privacy requirements;
  • technical developments or changes to functionality;
  • necessary clarification or closure of unintended regulatory gaps.

Amendments must not shift the contractual balance to the user's detriment without an objective reason. Material amendments will generally be announced at least 30 calendar days before they take effect by email, in the account or within the application. Users may terminate the agreement before the amendment takes effect.

Urgent amendments, particularly those required to address security risks or comply with immediately applicable legal or platform requirements, may take effect on shorter notice or immediately. Users will be informed as soon as reasonably possible.

Where the law requires express consent to an amendment, that consent will be obtained separately. Continued use will constitute acceptance only where legally sufficient and where the user has previously been clearly informed of that consequence and of the right to terminate.

23. GOVERNING LAW AND JURISDICTION

Austrian law applies, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections under the law of the country of their habitual residence.

For business users and legal entities under public law, the court having subject-matter jurisdiction in Vienna has exclusive jurisdiction to the extent permitted by law. Statutory places of jurisdiction apply to consumers.

24. FINAL PROVISIONS AND LANGUAGE VERSIONS

If any provision of these Terms of Use is or becomes wholly or partly invalid, the remaining provisions remain unaffected. The statutory provisions apply in place of the invalid provision. No reduction of an invalid clause to the maximum legally permissible extent to the detriment of consumers is intended.

Failure to enforce a right immediately does not constitute a waiver of that right.

These Terms of Use are provided in German and English. Both versions are intended to convey the same content. For a specific agreement, the language version expressly accepted by the user generally governs. Mandatory statutory rights are not restricted by a translation or linguistic inconsistency.
